ICE HOCKEY EVENT – SPECTATOR RISK WARNING, WAIVER ANDCONDITIONS OF ENTRY (TASMANIA)

By purchasing, accepting, using or presenting this ticket,or by entering or remaining at the Venue, the holder agrees to these terms.

WARNING

Ice hockey is a fast and dangerous sport. Spectators may beinjured by flying pucks, sticks, stick fragments, equipment, debris, shatteredor displaced glass, and by players colliding with boards, glass, gates orbarriers. Serious injury or death may occur.

1. Acknowledgment of risk

The ticket holder acknowledges that attendance at this Eventand presence at the Venue involves obvious and inherent risks, including riskof personal injury, permanent disability and death.

Those risks include, without limitation:

(a) pucks leaving the playing surface at high speed;
(b) sticks, stick fragments, equipment or other objects entering spectatorareas;
(c) players crashing or colliding into boards, glass, gates or barriers nearspectators;
(d) glass, boards, gates, barriers or safety infrastructure cracking, shifting,failing or causing debris to enter spectator areas;
(e) slips, trips and falls in seating areas, stairs, concourses, aisles andentry areas; and
(f) acts or omissions of players, officials, venue staff, contractors or otherspectators.

The ticket holder acknowledges that netting, glass and otherprotective measures reduce risk but do not eliminate it.

2. Assumption of risk

To the maximum extent permitted by law, the ticket holdervoluntarily accepts and assumes all risks associated with entering, attendingor remaining at the Event or Venue, including the risks described above.

3. Conditions of entry

Entry is conditional on the ticket holder:

(a) remaining alert to play and activity around the rink atall times;
(b) complying with all signs, warnings and directions of venue staff, securityand the Organiser;
(c) remaining within authorised spectator areas unless expressly permittedotherwise;
(d) not interfering with safety netting, glass, boards, gates or barriers; and
(e) properly supervising any child or dependent person accompanying them.

Any person who does not comply may be refused entry orremoved from the Venue without refund, to the extent permitted by law.

4. Release

To the maximum extent permitted by law, the ticket holderreleases and discharges the Organiser, venue owner and operator, participatingclubs and teams, league and governing bodies, and their respective officers,employees, contractors, volunteers and agents from all claims, demands,actions, losses, liabilities, costs and expenses arising from or in connectionwith personal injury, death or other harm suffered by the holder at or inconnection with the Event or Venue, where such harm arises from or is connectedwith the risks referred to in this document.

5. No exclusion of non-excludable rights

Nothing in these terms excludes, restricts or modifies anyright or remedy that cannot lawfully be excluded, restricted or modified.

6. ACL wording

If, and only to the extent permitted by law, and if theservices supplied in connection with admission to the Event are properlycharacterised as recreational services for the purposes of section 139A of theCompetition and Consumer Act 2010 (Cth), liability for death or personal injuryarising from breach of a consumer guarantee applicable to those services isexcluded to the maximum extent permitted by law. This clause does not applywhere liability cannot lawfully be excluded.

7. Minors

If the ticket holder is under 18 years of age, these termsoperate as a risk warning and condition of entry. The accompanying parent orguardian accepts responsibility for supervising the minor while at the Venue.

8. Governing law

These terms are governed by the law of Tasmania.
